State laws provide exemptions to protect your property

State laws provide a number of exemptions that protect your property, and your attorney may be able to advise you on which exemptions are best for you.

  • Homestead: Up to $5,000 in the equity of your home can be protected (a mobile home or similar dwelling constitutes a homestead if it is your principal residence).

  • Wages: 75 percent of your weekly, disposable earnings are exempt.

  • Other Property: Up to $3,000 in the value of all personal property.

Don't delay

The anti-debtor laws put great restraints on the process of filing. These laws present many difficult obstacles.

  • Impose a strict and complicated Means Test that restricts your ability to qualify for debt protection.

  • Require you to get a certification from a debt counselor that you made efforts to reduce your debt outside of bankruptcy.

  • Increase the work and cost associated with obtaining a Chapter 7 or Chapter 13 discharge.

If you think that you may be seeking to file, it just may be time to contact us now.
