In that way the surviving partner inherits the deceased interest (right of survivorship) in the real estate property and is NOT liable for any of the deceased's debt. I am sure MJ had the best legal counsel money could buy to find loopholes and protect his assets/debts. No wonder he kept piling up debt and getting away with it.
