Chapter 13 bankruptcy
A Chapter 13 protection may be better for you if you are behind in your payments for property that you want to keep after discharging your debts. For example, if you are late on your mortgage or automobile loan, and you want to get current with these payments and keep your property, you may do this under a Chapter 13 plan. If a large percentage of your debt involves unpaid federal taxes, and you have the ability to repay them over time, a Chapter 13 may be a better alternative for you. If you had your spouse or parent cosign on an auto or other personal loan for you prior to your filing, your creditor may go after your family member for the full amount of your debt. If you file under Chapter 13, your cosigner should be fully protected from your creditors as long as you make your payments under your repayment plan.
Chapter 7 protection
Chapter 7 may be a better option if most of your debts are unsecured such as credit card debt, medical bills, personal loans or judgments from automobile accidents. We may be able to help you eliminate unsecured debts, but secured debts don't go away. Your creditors may hold a lien against your property until the debt is paid.
When you file either Chapter 7 or Chapter 13, however, a reaffirmation agreement may be negotiated in which you agree to continue making payments in exchange for your right to keep the property. Chapter 7 may have become such a viable option because the law affords very broad protection to you against your creditors. In addition, your opportunity to rebuild your credit after may be greater than ever before.
So, you need to get started. You shouldn't live another day in financial torment.
