Bankruptcy myths
Many people are afraid to even think about filing Chapter 7 or Chapter 13 bankruptcy because they don't fully understand the law or its affect on their lives. Common myths include:
- "I won't be able to buy a house or a car, or rent an apartment, after filing."
- "I don't want to go through a difficult and time consuming court case."
- "Any lawyer can handle a Chapter 7 or Chapter 13."
Let's address these one by one:
You should be able to get credit after filing for bankruptcy. Although it may take you a little time to start purchasing things, you should be a good credit risk once you emerge from bankruptcy, and you should, in time, be able to purchase a car, get a credit card, rent an apartment and even buy a house. You can also receive help when making these types of purchases. Getting a co-signer could make the process much easier.
As for the idea of a court case, forget about jury trials, cross examination, and all of the other courtroom drama you see on TV. In many cases, you'll never appear before a judge. In many Chapter 7 cases, your case could be complete and your debts discharged in about four months.
You may want legal representation during your bankruptcy proceedings, however. And although any licensed lawyer can represent you in a case, would you hire a criminal lawyer for a real estate closing? Or a patent attorney for a divorce? You'll likely only file bankruptcy once in your life, so you should hire the right lawyer for this very important job.
