It's more urgent than ever to file quickly

The passage of the Bankruptcy Abuse Prevention & Consumer Protection Act of 2005 means more hardship for debtors and their Mesa bankruptcy attorneys. The credit card and banking industries have been lobbying Congress for over eight years to make it more difficult for needy consumers to be able to discharge their debts through Chapter 7 or 13.

Among the provisions of the bankruptcy law are:

  • A strict financial means test that will disqualify many debtors from filing under Chapter 7. Before a debtor may be eligible to discharge their unsecured debts, their income has to be below the median income of their state. If their income is above that level, they are not permitted to file their case under Chapter 7 and must instead use Chapter 13.

  • A requirement that all debtors must receive a certification from an approved credit counseling agency six months prior to filing. This is especially punitive because the debtor is forced to pay for this service and there is very little oversight on credit counseling agencies to make sure that debtors get reputable advice.

  • A provision making it easier for a court to dismiss a case outright or to convert a Chapter 7 case to a Chapter 13 case.

  • A provision permitting a court to impose sanctions on attorneys, or even on debtors, for filing a Chapter 7 case that is dismissed or converted to a Chapter 13 case.

Many consumer groups felt that it would have been more beneficial for Congress to have capped interest rates on credit cards and overhauled the health insurance industry so more individuals could be covered and provided better consumer education to prevent over spending and overcharging.

If you think you qualify for Chapter 7 - call 1-877-349-1309 today

If the weight of debt is affecting every aspect of your life, even your health, then filing Chapter 7 may be your best step toward rebuilding a more secure financial future. You may get immediate protection from your creditors when you file for Chapter 7. After filing a petition in court with the help of your lawyer, you must list all your personal information, including income, assets, expenses and debts. You must also indicate applicable exemptions under the state of Arizona to which you're entitled. The court appoints a trustee to your case and a court order is issued that prevents creditors from taking any further action against you outside of bankruptcy court.
