Using state exemptions to protect your property

Exemptions are laws passed by every state that allow you to protect certain types of your property from your creditors when you file under Chapter 7 or Chapter 13 protection. These include your home, car, pensions and IRAs, motor vehicles, clothing, tools, and other important property.   • Homestead: $200,000 homestead exemption

  • Wages: 75 percent of gross earnings

  • Automobiles: Up to $15,000 in equity in one motor vehicle.

  • Other property: Private libraries not to exceed $ 1,500 in value; all family pictures and keepsakes; necessary household goods not to exceed $10,000 in value; farm trucks, stock, tools, and supplies not to exceed $ 4,500 in value; professional libraries, office equipment, office supplies and the tools, instruments and materials used to carry on the trade of the judgment debtor not to exceed $ 4,500 in value; and the cabin or dwelling of a miner and his cars, implements and appliances not exceeding $4,500 in total value.
