The first steps you take are indeed the most important.
Properly preparing your bankruptcy petition is key to the success of your case. Your attorney may begin to prepare your petition with the information you provided on your free evaluation form. During your first meeting, he or she may ask for more information and keep you informed as your case progresses. If your financial situation changes during this period, or if you need to add any information, you should contact us immediately to make any changes.
Once your petition is finalized, we will then select the appropriate bankruptcy court to file your case.
The federal bankruptcy courts are located throughout the U.S., organized into 11 federal judicial districts. Typically, your case will be filed in the court nearest to your home. Once your case is filed, you will be assigned a case number, and might receive a very important order from the court called the "Automatic Stay." This is the official order that prohibits your creditors from taking or continuing any collection actions against you. The Automatic Stay may mean no more harassing letters, phone calls or lawsuits while your case is in progress.
The court will send a notice of your case to all of your creditors.
This may inform them that they can no longer call or bother you about your debt. In addition, the court will select a trustee to oversee your case. The trustee is a federal employee appointed by the court to verify the accuracy of your documents and make sure you are eligible for filing. The trustee will review your petition, make sure that it is complete, and verify that there are no assets available for liquidation.
