The first step in the Chapter 13 or Chapter 7 process should begin well before you ever get close to the courthouse. You need to find an experienced Washington bankruptcy lawyer.

For a Chapter 13 filing, your attorney will meet with you to assess your financial situation, explain the entire process and work with you to set up a debt repayment plan that you can live with. Once you hire someone with whom you are comfortable, your next step will be to file your petition. Your petition will list certain personal information about yourself, your spouse, and your family. You must also stipulate all your income, your property (assets), your expenses, and all debts (liabilities). Additionally, you must select the specific exemptions to which you should be entitled (exemptions are the laws that prevent your creditors from taking your property away from you). The court will likely issue an Automatic Stay order. This order prohibits your creditors from collecting their debts from you, from repossessing your car or other property, and from starting or continuing any legal actions against you.

You can only qualify for a Chapter 13 if you are able to meet the terms of your repayment plan. By law you are required not only to have a "regular" source of income, but also have sufficient "disposable income" to make your monthly payments in a timely fashion. If your secured debts (which include loans you have secured by liens on your property, such as your home and auto loans, and even IRS tax liens) exceed $922,975, you are not eligible for a Chapter 13. Also, your unsecured debts may not exceed $307,675 (unsecured debts are debts for which you have not pledged any of your property as collateral-such as most credit card debt, personal loans, and utility bills.

If most of your debts are unsecured a Chapter 7 may work best for you. If a debt is unsecured-that is, with no collateral backing it up-it typically can be discharged in with a Chapter 7 filing. Unsecured debts include credit card debt, medical bills, most personal loans and garnishments among others.
